Let’s look at the key points of the new version of the MYBA Memorandum of Agreement – Part One

The Myba Memorandum of Agreement (also known as the Moa ) is a contract form approved by Myba (Mediterranean Yacht Brokers Association) and most commonly used internationally for the sale and purchase of used yachts . It is a standard contract governed by English law, which consists of a first part, corresponding to the first two pages, to be filled in with the description of the yacht and the specific conditions of sale that are the result of negotiations between the parties, and a second part consisting of standard clauses governing the Seller’s rights and obligations, and finally the general conditions of the sale. Having been widely used and respected by brokers and lawyers for many years, the Moa has been an essential instrument in the buying and selling used yachts.
THE MEMORANDUM OF AGREEMENT HAS FOR MANY YEARS BEEN AN ESSENTIAL INSTRUMENT IN THE BUYING AND SELLING OF USED YACHTS.
Not everyone knows, however, that a new version of the Moa was launched in 2021. It is an update of the model that has been used since 2008 with the aim, on the one hand, to bring it more in line with current market practices and with changes in regulations and, on the other hand, to prevent a number of contractual aspects that are in practice susceptible to disputes between the parties. However, almost two years after the introduction of the E-Moa 2021, the previous version of the contract is still predominantly used, and this is undoubtedly due to the fact that the new version is electronic and can only be completed and used by brokers registered with the Myba. Therefore at least for the time being, brokers who are not members of the association and, above all, lawyers who normally assist the parties in drafting the Moa and its addenda are, at least for now, excluded from accessing this document.
The decision not to allow lawyers to prepare the contract directly and to be able to exchange the drafts prior to signing, except with the broker’s constant intervention on the text, inevitably represents a major obstacle to the dissemination of the new version and the application in the practice of the changes introduced . Therefore, it is hoped that the Myba will approve a widening of the audience of users who can have access to the E-Moa 2021, certainly by adding lawyers active in the yachting sector. This requirement has been expressed several times by many of the most established international law firms and is certainly to be welcomed since the changes made are undoubtedly useful and opportune in the light of the experience and market practice. We therefore begin our examination of these changes which we will continue in the next issue.
A first amendment, and also the most significant, concerns Clause 15 (Seller’s Warranty) which has been extended in two respects , compared to the previous version which only provided for the warranty regarding the Seller’s ownership of the yacht and the absence of mortgages, debts and claims over the yacht. On the one hand, a specific guarantee has been inserted regarding the absence of liability for the payment of Vat on the yacht until the date of completion of the sale in relation to the Vat status of the yacht which, in fact, must be declared in the new box (L) Eu Vat Status, introduced on the first page of the Moa . On the other hand, a specific guarantee has been inserted regarding the absence of debts and/or liabilities deriving from previous charter contracts operating in the case of commercial yachts, which in fact must now be declared in the new box (K) Plesure or Commercial Yacht, introduced on the first page of the Moa .
Of particular importance is the introduction of the Vat guarantee, as this is an absolute change in perspective with obvious consequences in terms of liability . In fact, under the previous regime, the seller did not provide any guarantee and the buyer had the burden of verifying the seller’s correct application of Eu Vat law before signing the Moa and/or completing the sale, with no recourse against the seller in the event of subsequent disputes by the tax authorities. We will continue our analysis of the changes introduced in the Moa in the next issues.

Return of The MYBA Charter Show: What To Expect in 2022

Held annually at the end of April, the MYBA charter show is an incredible opportunity for the yachting world to come together in the heart of Barcelona. Marking the beginning of the Mediterranean charter season, the MYBA Yacht Show in Barcelona is a true celebration of yachting.
The industry-only event brings a breath-taking fleet of superyachts, brokerage firms and yacht crews to OneOcean Port Vell, and is considered a must-attend event. Visitors and exhibitors can expect social entertainment, workshops, and awards ceremonies to indulge in fun and excitement, as well as ample networking opportunities.
Curated by the MYBA, the show represents the association’s commitment to encouraging and upholding high standards across all spheres of the superyacht industry. More than 2000 guests are expected attend across the course of the show, with over 500 exhibitors to explore.
Previous shows enjoyed 16 successful years in Genoa, Italy, before relocating to the stunning marina of OneOcean Port Vell in Barcelona this year. After 32 editions of the show, and 2 absences due to the ongoing pandemic, MYBA appears to be back in full swing – bigger and better than ever.
Here are some of the largest and most notable superyachts attending the 2022 show:
Victorious - 85m
Delivered last summer in Turkey, Victorious is a true explorer superyacht capable of circumnavigating the world whilst retaining the essense of true luxury. Built by AK Yachts, the 2,308 GT superyacht has a beam of 14.2m and an overall draft of 4.4m. Her build was initiated in the Chilean shipyard Marco Yachts and the vessel was originally dubbed Gin Tonic II. After a bumpy journey that included being shipped from Chile to New Zealand in parts, Victorious was completed in Turkey and then delivered fourteen years after her build began. There is a personal helipad on the bow of the vessel capable of holding an AC145 or equivalent helicopter transport, an indoor elevator and an impressive cinema to keep guests entertained. There is also a wine and cigar club room with a built-in fireplace which exemplifies the luxurious nature of the superyacht.
Her interior was designed by British based design studio, H2 Yacht Design and features accommodation for 12 guests in SIX cabins and includes a private deck for the owner’s personal usage. The superyacht is packed with amenities including a 200-square-metre beach club with three vast terraces that can unfold to create more outdoor space, a large indoor swimming pool, a fully equipped gym, relaxing spa and beauty salon.
She is currently listed for sale with Burgess .
Secret - 82.5m
Secret was commissioned and operated by a very experienced yacht owner, and she has been maintained to a very high standard. She completed her 5-year Class Survey in 2018 and had a full repaint in 2017. She comes to the market in turnkey condition and ready for a new owner.
Her striking exterior is the work of the renowned Sam Sorgiovanni and she comes packed full of features to entertain any type of guest. These include a cinema, gym, elevator, massage room and two large tenders. She is a fully capable global cruiser thanks to her range of 5,000nm and cruising speed of 14 knots.
Secret accommodates 12 guests in 6 staterooms with an additional 7th guest-finished cabin accommodating 3 children or staff. She is also capable of accommodating 23 crew members.
Stella Maris - 72.1m
Stella Maris is a spectacular 72-metre yacht, which represents a definitive step forward for VSY and is also conceived to be taken as a reference point for the market.
The project - entrusted to the expertise of the architect Espen Øino in cooperation with Laurent Giles Naval Architects – is blending traditional elements of design and layout with new variations on a theme, such as the staggered internal decks, the heights of the saloons and the innovative form of the bow. The resulting layout ensures a volume, more usually seen in yachts of greater dimensions, of 2,114 GRT.
Also, it was possible to share the various functions on board among the decks thus rendering greater flexibility for any further different layout requirements, flexibility which constitutes one of the corner stones of VSY building philosophy, with the aim of satisfying the widest possible requirements of the owner.
Besides there being one deck exclusively for the guests, there is a separate Owner’s deck and saloons with finished heights of 270 cm and the pleasure of enjoying green landscapes at sea - and this must be an exclusive novelty - with real house-plants crossing the decks. Concepts of the internal and external spaces are interpreted in a very unconventional way. For example, in the main and upper saloons and the Owner’s cabin, there are spectacular walls entirely of glass, thus allowing the eye to see and enjoy beyond what would normally be a rigid barrier. A certified helideck and a sundeck conceived also for evening use with suitable atmospheric lighting, are featured by essential materials and colour tones reminiscent of a Mediterranean beach which is even more emphasized by the large beach area located near the water. The interior design by Studio Reverberi is based on simple lines but refined, embellished with natural stones, fabrics and veneers that spell freshness, lightness and luminosity where the external and internal ambiences merge. Stella Maris is yet another example of VSY’s ability to interpret the most exclusive ideas of an Owner creating leisure craft where living as sea is an unimaginable privilege and pleasure.
She is currently available for charter with World Yacht Group .
Triumph - 65.4m
Triumph is a brand new 65.40 metre fully custom Benetti yacht with sleek and clean lines spanning her six decks. The steel displacement hull and the superstructure, made with aluminium, painted in a classic white with aft in striking black. The external lines were penned by Giorgio M. Cassetta, complementing the naval architecture by Benetti. Green & Mingarelli Design contributed to the interiors, adding to the work done in-house by Benetti. The aggressive streamlined exteriors were designed by Giorgio M. Cassetta notably using large curved windows to balance the yacht’s impressive presence.
The Sun Deck sits at the top the yacht on the sixth deck, not always present on yachts of this size. The crows nest features an elegant jacuzzi, comfortable seating and a table for Six that can be used even while navigating, thanks to ample wind sheltering. The aft cockpit on the Main Deck is an outdoor spot, sheltered yet in contact with the environment, perfect for conversation and relaxation at any time of day. Amidships, the large and bright living area, consisting of a dining and relaxation space, is complete with every comfort.
Triumph accommodates twelve guests in six sumptuous staterooms. The owner’s apartment, set over a sprawling 130 square meter area, takes full advantage of the deck’s spaciousness and stunning views. Also on the Main Deck, a large VIP stateroom considered as the second master dedicates an opulent suite to the guests. The sleeping area amidships includes two double cabins and two twin cabins with pullmans for an additional eight guests.
She is currently available for charter with Royal Yacht International .

The better way to sell a yacht – the 2021 MYBA E-MoA

For the first time in over 15 years - and with the benefit of experience from various contacts across the maritime industry – MYBA, the worldwide yachting association, has made material amendments to some of the key terms in its internationally recognised sale and purchase contract.
These changes seek to address and clarify many of the issues which frequently crop up during the negotiation of a yacht or superyacht sale. They also seek to reflect common practices in the industry that have developed over the years including, most recently, those relating to the Covid-19 pandemic.
With MYBA’s sale contract being the most frequently used agreement for second-hand yachts and superyachts sales worldwide, these changes are likely to have a significant impact on the way the majority of yacht sales are now conducted in the industry.
In practice, once the parties have agreed to adopt MYBA’s terms, they are rarely amended significantly. A good knowledge of those standard terms and the recent amendments is therefore essential for market participants across the industry including shipyards, brokers, stakeholders, owners and lawyers.
Some of those key changes are set out below.
Inventory: Instead of being agreed after the contract has been signed (which left the buyer with uncertainty as to what items were to be included on delivery), the inventory must now be agreed and attached to the contract before it is signed by the parties.
Force Majeure: Most likely as a result of the issues arising out of the pandemic, the Force Majeure provision has been amended to allow the parties to terminate the contract if delays caused by the force majeure event exceed 30 days. This provides an end date for the non-faulting party and means that these delays cannot continue for an indefinite period.
Most importantly, the change also requires the party intending to rely on the Force Majeure provision to notify the other party of that claim within two days of a triggering event. This is a process that yards will be accustomed to from similar provisions in build contracts.
VAT/tax: The seller is now expressly required to warrant that no undischarged tax/VAT liability has been incurred in relation to the yacht up to the date of its delivery. Depending on the market’s reaction to the change, there may be a concern that, as the seller has to provide an express warranty (and assuming liability) for the prior VAT position, this may lead to greater pressure on a buyer to accept incomplete or poor evidence of the past VAT position. In turn, after the seller has completed the sale and moved on, this may leave the buyer with difficulties in proving the position to any tax authorities and/or a subsequent buyer.
The broker’s commission: This clause has been extended to catch any direct arrangements between the parties’ sister entities, instead of merely between the parties themselves, and to ensure that parties cannot avoid the commission fee obligation by transacting a sale through sister companies.
Post condition survey damage: There are now express provisions that provide the seller with an opportunity to fix any post condition survey damage, however caused. Such damage can now be rectified by the seller to the standard of the buyer’s approval within 30 days. This is in contrast to the previous terms where no such opportunity was provided for, giving rise to a greater likelihood that the buyer might immediately or unfairly repudiate the contract.
No sea trial/condition survey until deposit paid: It is now clear that no sea trial or condition survey can take place until the buyer has received the deposit. It should also be noted that the new requirement is that the deposit must be “received by” the stakeholder as opposed to “paid to” the stakeholder.
KYC due diligence: KYC and due diligence requirements are now set out in greater detail and depth, with the parties having to meet the requirements set out in both Schedule A (setting out various due diligence documents) in addition to Addendum 1, which relates to the yacht’s certificates etc . The changes also now expressly require information to be provided on the ultimate beneficial owners.
The stakeholder obligations: There are now more detailed obligations and time limits imposed on the stakeholder. The stakeholder must now confirm that the KYC information discussed above is in order within the relatively short time period of eight days. Failure to do this will result in the contract being automatically cancelled.
In turn, however, under the amended terms, the stakeholder has greater legal protection when acting in accordance with the contract, including indemnities and an express waiver of liability from the seller and buyer for loss caused by its actions, unless that loss was a direct result of the stakeholder’s negligence.
The amendments help address some of the issues regularly arising in a yacht sale or purchase. For example, they clarify the use of the Force Majeure provision and give the buyer the right to rectify damage caused to the yacht post condition survey. The changes also go some way to addressing the perceived imbalance that the MYBA agreement is generally considered to be “seller friendly”.
Except for larger superyacht transactions where the Norwegian Sale Form (NSF) can sometimes be adopted, the MYBA MoA has historically been the “go to” text for yacht and superyacht sales. This is primarily because the MYBA MoA provides for early signature before the sea trial and condition survey.
The additional obligations placed on the stakeholder and the tight initial eight-day time limit (following signature) to satisfy KYC/due diligence may erode that advantage slightly. However, on balance, it seems likely that the 2021 amendments to the MYBA MoA will further build on this pre-eminence as the yacht and superyacht sale/purchase contract of choice – particularly now it is available in the MYBA-E electronic format.

This is a very special year for MYBA The Worldwide Yachting Association as it is celebrating its coral anniversary. Founded in 1984, by a small group of visionaries, MYBA is an international professional organisation whose focus is on safeguarding the superyacht industry’s interests and promoting standards of excellence. It has always been characterised by a strong belief in working together for the good of all and driven by a vision of a sustainable future for yachting.
As sustainability becomes an increasingly important topic, it is only natural that the Association feels an increased responsibility towards the protection of our oceans and the marine life that inhabits them. The fact is that yachting is an activity which relies heavily on a healthy natural environment and it’s in all of our interests to do what we can to minimise our impact on the planet. By adopting good practices across the superyacht industry, we can safeguard the waters we enjoy sailing in and depend upon for our livelihoods. In this light, MYBA has chosen not to celebrate its 35th anniversary in an ordinary manner such as staging an event or advertising the fact.
Instead it has decided to invest its time and communication resources in a campaign aimed at promoting the protection of our oceans. We first need to accept that human activities are primarily at fault for the current state of our oceans and although this may be disheartening, it also means that there is an enormous opportunity for us to turn the ship around – ‘the more we know, the more we can do’. There are a few easily achievable choices that can make a difference. The first one is the issue of waste disposal.
Over the past few years there have certainly been positive developments as far as waste management on board is concerned. More and more yachts are separating their waste and storing it correctly until they reach shore. Owners and crew are working hard to ensure that waste from superyachts does not find its way into the waterways. You may ask where MYBA fits into this equation. The answer lies in part with the MYBA Yacht Management Committee which is currently preparing a survey for captains in order to discover what happens to the waste when the yacht actually reaches shore. It seems that very few ports and marinas have the appropriate reception facilities and operational waste can, and often does, end up in the sea. So, it is imperative to discover more and MYBA has the network to do so.
Once the data has been collected it will be used to open dialogues with individual ports but also to initiate discussions at an EU level and within the International Maritime Organisation (IMO), where MYBA possesses a strong voice. The second choice to be made is to practice safe boating, which means anchoring away from areas with sea grasses and coral formations. The damage from a dragging anchor and/or chain can destroy decades of coral growth in an instant. Disturbance and destruction caused by anchors can also influence the three-dimensional structure of the reef and this loss of complexity can, in turn, have a negative impact on fish abundance as well as biodiversity.
We must check carefully before that anchor drops! ‘Taking nothing but photos, leaving nothing but bubbles’ is the third choice we can make. Respecting the ocean means never touching or taking something from the marine environment. While the compulsion to touch beautiful things that we see underwater may be natural, as we would like to ‘connect’ with them, it can cause serious harm. Human touch is toxic for coral and may even kill it, with the results not showing until months later. So look, but please don’t touch.
Over and above its efforts to generate awareness, and in cooperation with Yacht Carbon Offset, the Association is increasingly endeavouring to reduce the impact its activities have on the environment by offsetting most of the travel arrangements of MYBA Admin and with plans to offset the 2020 MYBA Charter Show. MYBA is also a strong supporter of Ecomer – Yachts du Coeur which has the ability and logistics to collect donations of good food, clothes and linen from large crewed yachts and redistribute them to those who truly need it. A Fort Lauderdale-based yacht broker is seeking to dismiss a lawsuit alleging that it and numerous other members of South Florida’s yacht industry engage in unfair competition by requiring 10% commissions be paid by purchasers of preowned boats.
Denison Yacht Sales is the first of a group of yacht brokers, mostly based in South Florida, to respond to allegations leveled in three antitrust lawsuits filed in U.S. District Court in Miami.
The lawsuits claim that trade associations, including the International Yacht Brokers Association, work in conjunction with Multiple Listing Services and individual yacht brokers to require that commissions are paid to brokers for both sellers and buyers.
The first lawsuit was filed by Wyoming company Ya Mon Expeditions on Feb. 29.
The second lawsuit was filed on March 22 by Alabama customer Kip Lamar Snell, while a third was filed on March 26 by a company called Magna Charter LLC, identified as a yacht purchaser who paid a commission.
On Monday, a federal judge assigned to two of the three lawsuits agreed to a request to consolidate them into a single suit.
The lawsuits are patterned after litigation that accused the National Association of Realtors of conspiring with real estate brokers to artificially inflate commissions paid when homes are sold.
A federal jury in Kansas City, Missouri, issued a ruling in October favoring the plaintiff. On March 15, the Realtors agreed to a settlement that’s expected to force major changes in how homes are sold in the United States.
Denison’s motion in the Ya Mon Expeditions case requests dismissal of the claims against only Denison, asserting that the company “has done nothing wrong and is being sued for merely being a yacht brokerage and having had an executive that served on the board of” the International Yacht Brokers Association.
Denison states that it has been “lumped into these broad-stroke allegations” that it has “implemented,” “adopted” and “enforced” a rule requiring inflated commissions of 5% each for the seller’s and buyer’s brokers.
The lawsuits refer to the alleged commission requirement as the “Buyer’s Broker Commission Rule.”
But Denison’s motion states that the broker “has no such requirement, does not require its brokers to be members of any association” and does not “require use of any MLS, nor mandate brokers pay cooperating brokers (inclusive of buyer’s brokers).”
Denison is “purely free market” and its “only major requirements are that its brokers be legally licensed and impeccably honest,” the motion states.
Further, the motion states that the lawsuit fails to make specific allegations regarding Denison while making “vague and conclusory” charges against all 15 defendants.
The only specific allegation that forms the basis for naming Denison as a co-defendant, the motion states, stems from company president Bob Denison’s membership on the International Yacht Broker Association board of directors, the motion states. That allegation cannot be used to hold Denison Yacht Sales liable, because there is a lack of “evidence of actual knowledge of, and participation in” what the plaintiffs allege is an illegal scheme.
Other shortcomings of the complaint, as identified in the motion, include failure to allege reasonable restraint on trade or an antitrust injury.
Denison is represented by Beverly Hills, California-based attorney Christopher Brainard, and Emily Heim of Bayramoglu Law Office LLC of Henderson, Nevada. Heim did not respond to an email on Monday and Brainard said he had no comment on Denison’s motion or the cases against the yacht broker industry.
Denison’s response is likely just the first of a cascade of court filings to follow as the consolidated case seeks class-action status.
Late last week, attorneys came forward representing defendants Boats Group LLC, Permira Advisers LLC, United Yacht Sales LLC, HMY Yacht Sales, Galati Yacht Sales LLC, MarineMax Inc., and Northrop & Johnson Yacht Ships LLC.
On Monday, U.S. District Judge K. Michael Moore granted a request by two of the law firms representing Ya Mon Expeditions and Kip Lamar Snell to consolidate the three “nearly identical” cases into one, effective immediately.
The judge’s ruling stated that consolidating the cases would “streamline these proceedings and eliminate unnecessary repetition and confusion.”
Moore, however, said he would decide on the law firms’ request to appoint them as interim co-lead counsel in the consolidated case “in due course.”
If the request is granted, interim co-lead counsel responsibilities would be divided among Robbins Geller Rudman & Dowd LLP, an antitrust firm with offices in 10 cities, and Miami-based Podhurst Orseck P.A., a nationally known firm that specializes in complex commercial and class action claims.

The possibility of using furfurol for the production of ash-free high-strength active carbons with spheroidal particles as adsorbents and catalyst supports is substantiated. A single-stage process that incorporates the resinification of furfurol, the molding of a spherical product, and its hardening while allowing the process cycle time and the cost of equipment to be reduced is developed. Derivatographic, X-ray diffraction, mercury porometric, and adsorption studies of the carbonization of the molded spherical product are performed to characterize the development of the primary and porous structures of carbon residues. Ash-free active carbons with spheroidal particles, a full volume of sorbing micro- and mesopores (up to 1.50 cm 3 /g), and a uniquely high mechanical strength (its abrasion rate is three orders of magnitude lower than that of industrial active carbons) are obtained via the vapor-gas activation of a carbonized product. The obtained active carbons are superior to all known foreign and domestic analogues and are promising for the production of catalysts that operate under severe regimes, i.e., in moving and fluidized beds.

Judge shows mercy to ex-Romulus mayor who spent campaign money on yacht club, wedding
Former Romulus Mayor LeRoy Burcroff used campaign funds to help pay for his daughter's yacht club wedding, his yacht club dues and a Florida vacation with friends — but he isn't going to prison for any of it, despite his guilty plea.
Instead, a federal judge on Thursday gave the convicted ex-politician three years' probation and four months' home confinement, sparing him a prison sentence that the government sought. Federal prosecutors had requested that Burcroff be locked up for 14 months for betraying the public's trust by using more than $15,000 in campaign money for personal spending.
"The residents of Romulus, Michigan, put their trust in defendant LeRoy Burcroff. Those who supported the defendant with their wallet and their vote likely never expected this aspiring politician to spend their hard-earned money on a family wedding, a Florida vacation with friends or a yacht club membership," Assistant U.S. Attorney Eaton P. Brown wrote in a sentencing memo that urged the judge to lock Burcroff up.
"Sadly, over a period of over four years, the defendant made a mockery of the city’s slogan — the 'Home of Opportunity' — by stealing thousands of dollars in campaign donations to enhance his lifestyle."
Brown added: "The defendant’s deceit and dishonesty must be punished."
'I made some terrible mistakes, made some terrible decisions'
Burcroff, though, convinced U.S. District Judge Denise Paige Hood to show him mercy. In a letter to the judge, the 59-year-old father and grandfather described himself as a prayerful man and avid community volunteer who was lucky enough to marry his high school sweetheart, raise children with her and pass down his family's theme to his kids: "Always do the right thing."
As for his crime — he pleaded guilty to wire fraud in 2022, admitting he used $4,500 in campaign funds to help cover his daughter's yacht-club wedding — he wrote:
"I agonize everyday over what I did. I wish I could do things over, but I know I can't."
He went on to say:
"I never thought I would be in this position standing before a judge, admitting to breaking the law, and asking for your leniency. ... I made some terrible mistakes, made some terrible decisions. ... I am so sorry."
While Burcroff pleaded guilty to one count of wire fraud, he did not admit during his plea hearing to using more than $15,000 in campaign money for personal reasons, which is what he was charged with.
According to the government, in addition to using campaign money to help pay for a wedding bar tab and church ceremony fees, Burcroff also did the following:
- In 2017, he used campaign money to overpay his membership dues at the Belleville Yacht Club. When the club realized the mistake, management wrote a $2,000 check to reimburse him for what they believed was an oversight. "This was no misstep, however," prosecutors wrote in court documents. "Upon receiving the reimbursement, (he) promptly deposited the sum into his personal bank account."
- In 2014, Burcroff bought a $23,000 Ford Focus with campaign funds that he used “extensively for personal purposes,” then later bought a $27,000 Jeep Wrangler that he used for “similar impermissible personal excursions.”
- In March 2018, he bought his way onto the board of a local trade organization, Power Transmission Distributors Association, by making a $1,000 donation to the group from his campaign account.
- In January 2019, he flew his wife and two friends to Florida for a weekend vacation — courtesy of his campaign donors. The couples stayed in a luxury hotel and dined in fine restaurants to the tune of more than $4,000 — all of which was billed to the campaign. The friends who accompanied him on the trip reimbursed him for their portion of the vacation. Burcroff then deposited the friends' money into his personal account, thus doubling his money.
In 2020, after WXYZ broke details about Burcroff's campaign scheme, Burcroff reimbursed his campaign $35,000.
Following Burcroff's sentencing hearing, U.S. Attorney Dawn Ison stated that Burcroff’s conviction and sentence"underscores our commitment to ensuring that" communities in southeast Michigan "are represented by public officials who have integrity and are seeking office not for their self-interest, but for the good of the people they are elected to represent.”
Added Detroit's FBI chief Cheyvoryea Gibson: "The former mayor's actions severely undermined the confidence of those who bestowed trust and faith in him and his office. ... We will not tolerate misconduct and will do everything we can to ensure justice is served."

I've been doing some research online about booking a luxury yacht charter and I keep coming across the term MYBA. I have no idea what it stands for or what it means. Please can you explain it?

Renamed MYBA The Worldwide Yachting Association a few years ago, MYBA has had a significant role in the superyacht industry over the past 30 years, in the fields of sales brokerage and charter especially. It works closely with Government Organisations, Coastguards, the International Maritime Organisation, and all actors in the industry to make it better. Both the MYBA Charter Agreement and the MYBA Memorandum of Agreement have been developed over the years and provide an industry standard throughout the world. California Yacht Club is located at: 4469 Admiralty Way, Marina del Rey, CA 90292 .
- If driving, please park in the CYC visitor’s lot adjacent to Admiralty Way and accessed from the driveway which is between Café del Rey and the Warehouse Restaurant.
- Once parked, proceed by foot and enter the member’s parking lot by passing by the main entry gate.
- After passing the main entry gate, continue walking, bearing hard left along the chain link fence at the north end of the large parking lot until it ends at a dark green shade cloth covered rowing shed.
- We meet, at the rowing sheds which are opposite the tall bamboo plants separating the Warehouse Restaurant and CYC.

Participants should bring: athletic shoes (running shoes), socks, shorts, shirts, sunscreen, water, a change of clothes,
towel and personal items (hats, sunglasses, orthotics, inhalers, etc).
To keep all the gear organized, a small duffel bag or back pack is recommended.
Clothes should fit reasonably tightly so while rowing, hands won’t get caught in shirts and shorts won’t get caught in the sliding seats.
Dressing in layers and using wicking type fabrics is recommended.

Peter Duncan and Relative Obscurity Return to the Podium as J/70 World Champion at California Yacht Club
Peter Duncan’s Relative Obscurity has prevailed over 60 other teams and challenging wind conditions to capture the 2021 J/70 World Championship title at California Yacht Club, today. In a five-day series that tested the skill and patience of top-notch competitors from 11 nations, Duncan – sailing with Willem van Waay, Morgan Trubovich and Victor Diaz de Leon – secured a top five position in the beginning of the regatta and never let go.
“I’m elated!” said Duncan as he returned to the dock, bustling with activity. “That was a tough day out there. We didn’t start very well but had a bit of a break with a header on the first run of the second race that let us get close to everybody and sail through some folks we need to sail through,” he explained. “We have a lot of fun onboard – joke and laugh and keep it light – and that worked in our favor when we had to grind through. Everybody knows what their job is, and these guys do them exceptionally well.”

The J/70 Class has been created as a strict one-design Class where the true test when racing is between crews and not boats and equipment.
Well, chances are it will not be like Day 1 of the Pre-Worlds. Maybe more like Day 2. But then again, this is MdR—anything can happen.

CALIFORNIA YACHT CLUB
Founded originally in 1922 by yachtsmen including Charles Hathaway and Frank Garbutt, the California Yacht Club's first clubhouse was built in Wilmington, CA in Los Angeles' inner harbor (berths nos. 192 & 193), just opposite Terminal Island. Close by were the yards of renowned yacht builders Wilmington Boat Works and Fellows & Stewart (second location). In the club's inaugural year, member yachtsmen formed the first Star class fleet on the Pacific coast. Involved in all aspect of the sport, the club has encouraged a variety of pleasure boating, first in Los Angeles Harbor, and now in Santa Monica Bay.
Over the years CYC has been the club for numerous prominent yachtsmen including Merritt Adamson, Pierpont Davis, Roy E. Disney, J. Paul Getty, Samuel K. Rindge, William Stewart, James Kilroy and navigator extraodinaire, Ben Mitchell. Movie mogul Cecil B. DeMille once served as a trustee of the club and donated a gold cup for powerboat racing. Comedy film producers Al Christie and Hal Roach were both deeply involved in club activities in the twenties and thirties.
Power boating has always been a part of the club's mission along with sailing and rowing. The first CYC powerboat regatta was run in 1922 and the winner was none less than the famous Gar Wood in his Harmsworth Trophy winner Miss America. CYC's Catalina Challenge race for powerboats has been run annually since 1922.
A fire on Thanksgiving Day, 1930 severely damaged the original clubhouse although the heroic efforts of some members saved all of the trophies.
In 1932, several CYC members figured prominently in the sailing events at the Los Angeles Olympic Games. Owen Churchill, inventor of the SwimFin, won the gold medal in the Eight-Metre Class with Angelita.
Unfortunately, the club was forced to relinquish its key location in the East Basin to the Coast Guard for the war effort in 1941. A dormant period followed.
With the development of the long-awaited Marina Del Rey in the early 1960s, the club reformed in '63 and elected Fritz Overton, Commodore in 1923, as head of the "new" club. In 1966, they opened the modern clubhouse and marina facility that is their home today. The radial design of the building allows sweeping panoramic views of the marina.
The California Yacht Club is owned by the Hathaway family, owners of the Los Angeles Athletic Club. The annual "Great Catalina to Marina del Rey Rowing and Paddling Event" pays tribute to Charles Hathaway's row in 1976 from Catalina Island to the club on his 50th birthday.
The unique combination of private ownership and annually elected flag officers has worked well to establish California Yacht Club as one of the outstanding clubs in the nation.
‘Nothing left’: After California Yacht Club fire, residents mourn loss of a beloved spot

In an instant, an overnight seaside blaze engulfed decades’ worth of boating trophies, historical artifacts and cherished memorabilia at the California Yacht Club in Marina del Rey on Monday.
Fire crews attempted to control the blaze as heavy smoke and flames consumed the two-story building. By the time they had subdued the fire two hours later, only the skeletal remnants of the clubhouse were left standing.
John Myers, senior vice president of the club, said the blaze had been reported by an employee working late in the clubhouse Monday night. The fire spared the remainder of the facilities on the ground, including the docks and the yachts moored there. But the clubhouse, and particularly its second floor, was all but wiped out.
“We are working closely with the Los Angeles County Fire Department in their investigation of the cause of the incident and will share those findings when they become available to us,” Myers said.
Members are left mourning, comparing the loss to the death of a loved one.
Jennifer Dakoske Koslu awoke in Rancho Mirage at 5:30 a.m. Tuesday, before the sun had risen, to find her phone inundated with text messages from club members.
The first message she read simply stated, “The CYC is gone.”
“As soon as I opened my phone, it went to a link on the Citizen app and saw a video of the club burning. I was shocked,” Dakoske Koslu said.
For the last 24 years, Dakoske Koslu and her family have been dedicated members of the CYC, whose clubhouse is a few miles away from their home in Playa del Rey. She said it is where her children have grown up, familiarizing themselves with every inch.
“I remember taking my son there on the Fourth of July when he was just 3 weeks old. It was the first place we went with him as a newborn,” Dakoske Koslu said.
She and her husband biked to the club in the aftermath of the fire, greeted by the charred remains of the building on Wednesday afternoon.
“The destruction is unbelievable. It’s clear that the fire was burning intensely on the second floor,” Dakoske Koslu said. “There’s nothing left.”
The second floor once housed a collection of the club’s prestigious racing trophies, kept on display for members and visitors. The fire melted all but a single salvageable California Cup. Most notably, the priceless King of Spain Trophy, acquired in 1929 from King Alfonso XIII, was lost.
Additionally, the club lost cherished photographs of every past commodore, a significant position within a yacht club. Members said they didn’t know if anyone had digitized the images of the commodores or of the club’s founders.
“We would tell yachting stories at the bar around lots of memorabilia, and the yachting artifacts behind the bar are all gone now,” Tom Materna said. “The yacht club provided us a facility for the off-the-water celebrations after hard-fought competition on the water.”
The CYC dates to the early 1920s, started by boat owners from the Los Angeles Athletic Club and other yacht clubs. The Board of Harbor Commissioners approved the first clubhouse in 1922, designed by famed architect Edwin Bergstrom, co-designer of the Pentagon.
In 1965, the yacht club submitted a proposal for an all-encompassing $1-million, two-story, 10,000-square-foot clubhouse on four acres off Admiralty Way. Members envisioned a state-of-the-art facility with 170 boat slips, a guest dock, a small boat hoist and a dry land storage facility for boats. The clubhouse that resulted was dedicated on June 10, 1967.
Then-Commodore William A. DeGroot Jr. told The Times that the triangular parcel of land on which the clubhouse still sits is a “perfectly logical place for a club facility, and a commanding view down the main channel of the marina.”
Though the building has historical significance to its members, it does not have a historic designation, according to Linda Dishman, president of the Los Angeles Conservancy.
“We are deeply saddened by this tragedy and so grateful for the outpouring of support from the community and our members,” Myers said. “CYC has been a beacon for the nautical community for the past 101 years.”
Materna, 68, first found out about the fire through Facebook as friends posted videos and photos of the damage Tuesday morning. Then he began receiving calls and text messages from friends.
“Everybody woke up in the morning and realized we’d lost a significant part of the sailing community,” Materna said.
His connection to the club dates back nearly 52 years, to when he was just 16 years old. After spending 30 years sailing professionally with Hobie Cats, mainly racing catamarans — a watercraft with two parallel hulls of equal size — he recently served as a crew member on other club members’ racing yachts.
The CYC is pivotal in the boat racing community, organizing and hosting events such as the Optimist National Championship and Junior Olympic trials, Materna said. He fondly remembers the hundreds of people from across the globe converging on the marina for similar events.
The main topic among members now is what’s next for the club. Dakoske Koslu noted that the club’s ownership changed over the last few years, and many are unsure and concerned about the club’s continuation after the fire.
The club relocated to the marina in 1967, leasing the land it sits on from the county.
“I don’t think the county has really valued the contributions of the California Yacht Club as an important part of the Marina. They value Trader Joe’s because it’s more money for them,” Dakoske Koslu said.
Dakoske Koslu said she’s seen numerous small marine-oriented businesses displaced from the marina, making way for more commercialized developments such as Trader Joe’s and Recreational Equipment Inc.

California Yacht Club was established in 1922 and boated its' first competitive rowing team back in the 1930's. In 1977, after a long hiatus, Stan Mullin, Ken Jacobs and Charles Hathaway reactivated rowing at the Club. CYC rowers now number about 60, and represent all abilities, ages and motivations.
