Falmouth Harbor, an attractive, contemporary marina, makes a nice place to start your charter. Sights to See In Antigua

On your Antigua charter, there are two special places you might want to take in. Once Great Britain’s most important Caribbean military base, English Harbor is now 18th century fort ruins and museums. The legendary Horatio Nelson once sailed here, and with the number of safe harbors in the area, it has become a popular yachting destination, so you can too! One of the most popular destinations, Nelson’s Dock Yard, dates back to 1743. It is home to a variety of restaurants, galleries, shops, and even a nautical museum. In the museum, you will find Lord Nelson’s telescope!

Why Go to Antigua And Barbuda?

The reasons for visiting are varied. Northeast trade winds are nearly constant around Antigua and Barbuda, both relatively small islands, 108 square miles and 68 square miles, respectively. These winds make for excellent sailing and cool the streets of the capital of Antigua, St. John, making for a pleasant walking tour of the city.

Nature and tranquility are surround you in the rain forest, or places such as the Frigate Sanctuary on Barbuda. There is an amazing list of activities, including carnival celebrations, concerts, food, and parades, or for the more adventurous, there is snorkeling, zip line eco tours, or exploring Indian Cave with its Arawak Petroglyphs. In short, there is something for everyone on an Antigua charter.

Differences Between The Islands

Perhaps reflective of the size discrepancy between them, the number of attractions and accommodations is also weighted in Antigua's favor. Barbuda should not be dismissed, though! Antigua may be home to hundreds of beaches, but Barbuda being the smaller, quieter sister boasts 17 miles of beach - and fewer people. Barbuda is a charming, unpaved island with only a couple hotels and tranquil waters (due to the surrounding barrier reefs).

The culture and habitat of these islands leaves visitors feeling wistful about historic charm and invigorated about natural wonders. The colonial atmosphere coupled with a colorful ecosystem practically upstage Antigua's infamous yachting scene. This two-island nation is able to easily provide people with social activities as well as quiet reprieves.

History, Culture & Natural Habitat

These two islands boasts a wonderfully inviting West Indian character replete with calypso music, Carnival celebrations, and generously spiced dishes. Historically speaking, Antigua retains ties to its naval significance by way of Nelson's Dockyard, which is a renovated base that now serves as a popular meeting spot.

From Nelson's Dockyard you can walk to Falmouth Harbour 's horseshoe-shaped bay where you'll find a nice offering of restaurants on the east side. The island's tourist center is actually located in St. John's , which is also the capital. Restored stone buildings and some wooden huts have been repurposed as shops and galleries at Redcliffe Quay .

English Harbour is home to Nelson's Dockyard, Fort Berkeley, and the ruins at Sandy Heights . This is also the island's yacht haven and a good base for your charter yacht as you continue to explore the scenic offerings. Take in the abundant mangrove system, marshes, and salt ponds while you attempt to spot a seemingly endless variety of birds.

Guiana Island (just off Antigua) has the country's remaining parcel of forest and the distinction of being the only habitat for tropical mockingbirds. There is a large colony of nesting seabirds here, and you'll definitely want to head over to Barbuda's Codrington Lagoon to check out the equally impressive Frigate Bird Sanctuary .

Serene Sanctuary

The sanctuary is accessible only by boat so you'll know you're approaching something special before you even get there. In spite of 170 bird species on island, you'll still be able to pick out the show-stopping Fregata Magnificens on account of its impressively large wingspan. While on Barbuda, take advantage of the calm and enjoy peaceful pink sand beachcombing or solitary shipwreck diving.

Back on your Antigua charter, luxuriate in the easy waters of Runaway Bay or bask on the active shoreline of Dickenson Bay. Deep Bay is another option if you like swimming, and a trip out to the coral covered wreck of the ship Andes in the middle of Deep Bay is always an adventure. Go sailing around Antigua, the main island in the Caribbean nation of Antigua and Barbuda. The island's heavily-indented coastline offers a huge variety of overnight and day-stop anchorages. Antuigua is compact enough to comfortably circumnavigate in vacation mode over seven days.

If a short blue-water passage is one of your holiday objectives, there is time to visit Barbuda. Charter for 14 days, and you'll have the opportunity to enjoy all nature has to offer on this less-visited tropical island. And also enjoy more of Caribbean island life, in all its colourful variety. 

Nature, History and a Hundred Peaceful Coves

At 281 sq. km, Antigua Island is the largest member of the Leeward group with British colonial heritage. Its numerous bays and small coves, and the offshore reefs that shelter them, have made this a wonderful charter holiday destination. A week-long charter allows time to enjoy the island, meeting its people and exploring its rich history as well as playing on and in the water.

A 14-day charter opens up a whole new world of adventures, with a 23 nautical mile passage to sparsely-populated Barbuda, plus all those little treasures on the main island that you may otherwise miss.

St. John's is the capital, a modern city of 80,000 through which land-based and cruise ship visitors to Antigua inevitably travel. On bareboat charter, visit St John's at the start or end of your trip. Once aboard at Jolly Harbour you can then make the most of your sailing vacation with stopovers close by in such places as Five Islands Harbour and Deep Bay (where you may wish to snorkel the Andes wreck). All are near the city but far enough away to seem like another world. If time allows and there's the desire to do a short open-water passage, depart Dickenson Bay early morning for Barbuda.

Barbuda is worth at least a two-day visit, with a big attraction being the Frigate Bird Sanctuary tour in Codrington Lagoon. There are anchorages at Low Bay right by the lagoon, and at the southern end of the island at Cocoa Point. 

Back at Antigua, your clockwise circumnavigation continues with stopovers at Jumby Bay on Long island or on Great Bird Island, both inside the Boon Channel and offering great snorkelling and water sports generally. Around this northern part of Antigua there are uninhabited islands to explore until day is done. And there's more of the same round at Nonesuch Bay, where the reef provides good shelter from the prevailing easterlies. Like several of the places you stop at along the way, the local resorts open their restaurants to passing sailors, and sometimes other facilities as well. 

English Harbour is an Antigua 'must see' for boaters. Here a young Horatio Nelson was second-in-command of the British station, from which the Royal Navy kept a watch on French possessions to the south. Nelson's Dockyard is now fully restored and functioning, a major drawcard for visitors to the island. The larger Falmouth Harbour, home of the Antigua Yacht Club, is immediately to the west of English Harbour. 

Your voyage around Antigua ends with your final day spent in Carlisle Bay. Or sail directly back to Jolly Harbour to enjoy some of the inland attractions, such as that shopping excursion to St John's, or an invigorating hike to the lush Christian Valley.

Whichever way you look at it, Antigua has it all for the bareboat charterer and holiday crew.

Sailing Conditions in Antigua & Barbuda

As part of the Leeward Islands, Antigua and Barbuda lie in the path of the trade winds that steadily blow from east to southeast at strengths between light and fresh, rarely exceeding 20 knots. With winds from the north and west virtually non-existent, combined with the sheltering effect of the indented coastline and reefs, it is easy to plan a series of safe and comfortable overnight stays just about anywhere around the island of Antigua. Barbuda's best anchorages are equally sheltered, in the west and south of the island. 

Expect to sail in consistently warm daytime temperatures ranging from 82ºF (28ºC) in January to 88ºF (31ºC) in August. The interior comprises mainly low hills, making Antigua and Barbuda relatively dry islands, with summer being the wettest season.

Do you want a quality vacation in a breathtakingly picturesque environment? Have you had enough of crowded popular resorts? Antigua’s archipelago is the perfect choice for you. Christopher Columbus discovered and named Antigua. Its northern side is a strongly shattered limestone board, the south is the remnant of a rundown volcano. Antigua and Barbuda is a member of the Commonwealth of Nations, the Caribbean Community, and the Organization of Eastern Caribbean States.

Location of Antigua

The tiny independent Central American island nation lies in the middle of the Leeward Islands, where the Atlantic Ocean meets the Caribbean Sea. The state consists of three major islands. Barbuda lies northward from Antigua. It has a flat surface of coral limestone. Redona is the smallest of the three and uninhabited. Its 300 m high rocks have volcanic origins. 100 963 people live on the island of 442 km2.

Can you rent a crewed yacht in Antigua – do I need a license?

Crewed yachts, cabin charters and gulet charters may not require a license. You can only rent these boats with a skipper only.

There are many ports and anchorages in Antigua, we will list some of them:

Falmouth Harbour

The harbour is located on the south coast of Antigua. It is only a few minutes’ walk from the famous Nelson’s Dockyard Maritime Museum. In the well-equipped harbour there is drinking water and electricity available. The harbour can accommodate larger boats up to 100 m in length. The AYC Marina is home to a regatta in April and the following Antigua Sailing Week.

Catamaran Marina

It is located north of Falmouth Harbour, just minutes from the hustle and bustle of the harbour. However, the distance is enough to make the marina peaceful and quiet. The marina has 60 berths for boats up to 60 m in length. The depth of the seabed is 4 m. In the marina, there is 24-hour security, a hotel and two restaurants.

Nelson’s Dockyard

Nelson’s Dockyard is a 45-minute drive from the capital. It is one of the most famous sailing destinations . Also, the Dockyard is a UNESCO World Heritage Site. Thanks to regular maintenance and restoration work, the port still preserves its 18th-century look. Once it was a naval base for the British Royal Navy. Today, the Dockyard is part of a complex with museums, parks, restaurants and cafés. You need a permit to berth with your own boat, but you can easily berth with chartered boats.

Jolly Harbour Marina

Although Jolly Harbour Marina is not the largest marina on the island, it is well-equipped and offers quality services for sailors. Whether it is boat maintenance, storage, bicycle rental or even a hairdresser, sailors are not in short supply. The marina has 155 berths of drinking water and electricity.

Beaches in Antigua

This group of islands welcomes lovers of the sea with beautiful open and hidden beaches. You’ll find amazing gulfs and white sandy shores here. Diving is among the most popular pastimes. The crystal clear water is ideal for discovering the wildlife of the sea.

Gulf of Dickenson:

This beach is a typical Caribbean seaside. The Gulf of Dickenson is amile westward, with hotels standing above the golden sandy shore. It’s a lively beach with sports opportunities and beach bars. Local establishments provide deckchair rental opportunities and other services. Take a chance and try a glass floor voyage, banana boat, or jet ski. Rent a boat to explore the beautiful sea.

Pigeon Point beach:

A spot of sand near Falmouth port, Pigeon Point is the main public beach on the southern side. It welcomes families with children with shallow water and seagrape trees. The French menu and a variety of wines further enhance the elegance of the shore. There’s another bar on the other end of the beach serving simple Indian dishes and cocktails. Main sights in Antigua

Antigua is not a big group of islands. Overseas, however, you have plenty of opportunities to explore the outlying gulfs and reefs by boat. Antigua was a part of the Caribbean region of the British Colony. These times left significant historical memories. This is best illustrated by the multitude of fortresses on the islands. The modern era has arrived here, but the capital, St. John’s, is still worth a peak. The Antigua and Barbuda Museum contains catalogs about the history of the islands. Which period is best to sail in Antigua?

The Caribbean region is characterized by the all year long hot and humid tropical climate. The weather is somewhat cool and dry from the middle of January to the middle of April. From the middle of June to the middle of November it’s usually hot, wet, and rainy.

The climate diagrams are based on 30 years of hourly weather model simulations. They give good indications of typical climate patterns and expected conditions (temperature, precipitation, sunshine, and wind). The “mean daily maximum” (solid red line) shows the maximum temperature of an average day for every month for Antigua. Likewise, the “mean daily minimum” (solid blue line) shows the average minimum temperature.

The wind rose for Antigua shows how many hours per year the wind blows from the indicated direction. The diagram for Antigua shows the days per month, during which the wind reaches a certain speed.

Antigua has a stable year-round tropical climate, like other islands in the Caribbean. On the coast, the climate is generally sunny and pleasant year-round. Average temperatures on the island vary usually from 20º to 30º C. The dry season lasts from December to March, the daily average temperature is around 25 º C. From April to October the daily averages are around 28 °C. The rainy season starts in May with showers till November. September is usually the rainiest month. Hurricanes may occur from June through November, most likely during September.

Captain: Jeff Black

Jeff is originally from California and spent most of his childhood as Freestyle skier and snowboarder in Lake Tahoe. In the summers, he would enjoy the waters of the lake parasailing, jet skiing and boating. He found his true calling was watersports. In search of warmer weather and salt water, he moved to Key West. He got his foot in the door with the boating world with boat building which progressed quickly into becoming a chief mate and ultimately the worldwide Captain he is today. Jeff established himself as an exceptional Motor Yacht and Sailing Yacht delivery Company working all over the world including Trans-Atlantic crossings. Captain Jeff finally discovered the USVI and BVI for term charter operations, one of his favorite places in the world. Jeff followed his thirst for the ocean and developed his passion for spear fishing, scuba and snorkeling, sailing, free diving, lobstering, and enjoying marine life. Captain Jeff has sailed all over the crystal blue waters of the Caribbean Sea. Wherever you want to sail to find your dream vacation Jeff will know the perfect spot, whether you want to be in the mix of the island, hiding with the locals, or even on a private island. Sail away and Island hop with Captain Jeff. Ashleigh grew up on the shores of a small beach town called Ballito, South Africa. During her junior and teen years, she swam breaststroke for Nationals as well as captained the South African Action Netball team while touring to Australia. When she is not in the pool or on the court you can find her free diving crayfish with her father, going hunting with her family in the bush, cooking food for friends and family, mountain biking, dancing, surfing, basically doing absolutely anything outside in the sunshine. Ashleigh has a great love for people that fuels her love for food. She believes that when there is great food around there will always be people around. This is what draws her to cultures, cuisines, countries, and new sports around the world. Her love for food is almost as great as her love for family and God. And so, with very little convincing needed and a lot of prayer, her father bought a 53Ft Catamaran and decided to sail across the Atlantic with her to fetch their new boat that awaited them all the way in St Thomas. Ignorance was bliss as they had never sailed before, but 2 months straight at sea during Covid was the best time of their lives. It brought Ashleigh into the world of yachts and sailing, and she has not left it since. She has spent the last year (2021-2022) onboard a luxury superyacht as the soux-chef for a crew of sixteen as well as assisting in cooking for twelve guests when on charter. She did a dual season (Caribbean and Mediterranean) and enjoyed it thoroughly. Now she is excited to start this great journey where she can cook and bring people together as well as have fun on the water and bring adventure to anyone who joins her onboard.

The perfect place to start your Antigua Yacht Charter is from the spectacular English Harbour. Make sure you take time to visit the Shirley Heights look out so that you can capture a stunning photograph of your luxury yacht. Sunday nights at Shirley Heights are famous for the Steel Pan Music night. Besides that, larger luxury yachts and Superyachts will moor in the neighbouring Falmouth Harbour.

From English Harbour you can explore the famous Nelson’s Dockyard. As you sail out of the harbour you can view the stunning Pillars of Hercules on the headland.

Green Island

Green Island is located on the East coast of Antigua. Enter in-between the reef to this sheltered bay with stunning turquoise waters. Therefore, moor off this uninhabited island and explore ashore. Snorkeling here is fantastic! Besides that, it’s a great spot for Kitesurfing. If Kitesurfing is your passion we can recommend a charter yacht that offers free Kitesurfing included in your charter price. This is a perfect spot for watersports. Her teak interior is accented by art and curios from Larry's cruises on THE DOVE through the Pacific, South China Sea, Indian Ocean Mediteranean, Caribbean, South America and even the Antarctic.

THESE TERMS ALSO CONTAIN A LEGALLY BINDING RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK. By creating a username, a login, clicking submit, using the services of Charter Experts, LLC d/b/a Virgin Island Sailing® (“ Broker ) or by accessing Broker’s website, you agree that you have read, and acknowledge your acceptance of these Terms. The Terms are subject to change at any time without notice at Broker’s sole discretion. Additionally, any transaction for which you have made payment shall be governed by the form of Terms in effect at the time of such payment notwithstanding any subsequent changes hereto.

If you are obtaining a quote, information, booking travel for and/or securing or procuring a Charter (as that term is defined in Section 1 below) for more than just yourself, all references below to “Charterer” or “you” (and derivations thereof) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote, information, booking travel for and/or securing or procuring Charter.

These Terms shall be read together and construed, to the fullest extent possible, to be in concert with any other agreement by or among Broker and Charterer. To the extent they cannot be so construed, then in the event of any direct conflict between these Terms and any other agreement by or among Broker and Charterer (including but not limited to the agreement executed by Charterer for a Charter Reservation (as that term is defined in Section 1 below), these Terms shall prevail.

• Prepaid Charter Reservations . Typically, Broker negotiates charter rates in advance with the yacht owner or charter company (“ Charter Provider ”) to obtain cost-effective rates, and facilitate reservations and availability for yacht charters, excursions and travel (the “ Charter ”). Broker also provides services to you by facilitating the booking of reservations for consideration and receives a commission from the Charter Provider (the “ Broker Fee ”). The Broker Fee is included in the pre-negotiated Charter rate provided to you, plus taxes and other fees where applicable. You agree that your payment is for the total amount set forth in the applicable Charter agreement (which Charter Provider may refer to as a Charter Contract, Charter Agreement, Booking Terms & Conditions, Instructions and Terms for Accommodations, as well as other derivations) provided to you by Broker (“ Charter Agreement ”). Upon execution of the Charter Agreement and receipt of the applicable deposit, you will have made a reservation for the Charter that authorizes Broker to facilitate the Charter on your behalf (“Charter Reservation”), including making payment arrangements with the Charter Provider. You further agree that Broker is a third-party beneficiary to the Charter Agreement and shall have the right to enforce such agreement to the extent it deems such enforcement necessary or advisable to protect its rights hereunder or under the Charter Agreement.

  Broker retains the Broker Fee as compensation in arranging your Charter Reservation. The Broker Fee varies based on the amount and type of Charter and/or services provided by Broker.  By making a Charter Reservation, you accept and agree to the relevant cancellation and no-show policy of the Charter Provider set forth in the Charter Agreement. Cancellation and no-show policies vary for each Charter. Carefully read the Charter Agreement and additional information provided to you by Broker. It is expressly agreed by Charterer that the Broker Fee is earned at the time the Charter Reservation is made. Late payment, wrong credit card or debit card details, invalid credit or debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any prepaid amount unless the Charter Provider expressly agrees otherwise under the Charter Agreement or in some other signed writing.

• Charter Rules and Restrictions . Additional terms and agreements will apply to your Charter Reservation and any purchase or rental of equipment or other items, supplies, provisions and travel you may select. Please read those additional terms carefully. In particular, if you have purchased airfare, please ensure that you read the full terms and conditions of carriage issued by the supplier. You agree to abide by the terms of purchase imposed by any supplier with whom you elect to deal, including but not limited to payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability, charges, fares, and use of products and services.
• Payment . All payments must be made by personal check, bank/wire transfer, ACH payment and/or with a major credit card unless otherwise expressly stated. The total price for the Charter Reservation will be billed in U.S. Dollars unless otherwise stated. Some banks and credit card companies impose fees for international transactions. If you are making a reservation from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the amount provided by Broker for the Charter Reservation. In addition, a foreign transaction fee may be assessed if the financial institution that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the financial institution or card company. The currency exchange rate and foreign transaction fee is determined solely by your financial institution on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your financial institution. Broker shall not be liable to you for any such service, conversion, or exchange fee.

  Broker expressly reserves the right to cancel your Charter Reservation if full payment is not timely received as set forth in the Charter Agreement.

• Cancellation and Rescheduling . You may cancel or change your Charter Reservation as set forth in the Charter Agreement by and among you, the Charter Provider and/or Broker. Please note that some Charter Providers do not permit changes to or cancellation of reservations after they are made, or after a certain date, as indicated in the Charter Agreement. You agree to abide by the terms of the Charter Agreement with respect to your Charter Reservation. Broker will not be responsible for reimbursing Charterer for any previously tendered deposits or payments by Charterer and disclaims all liability for the failure of a Charter Provider to refund or return any such funds.
• Credit Card Transactions and Chargebacks . If for any reason, any Charter Provider is unable to provide the Charter, or any part thereof, for which you have contracted, your remedy lies against the Charter Provider, and not against Broker. However, Broker will use reasonable efforts to assist you and Charter Provider in reaching a resolution to a dispute between you and the Charter Provider. In the event that your payment has already been transferred from Broker to Charter Provider or to an escrow account, you agree that you will not seek a chargeback against Broker for such amounts transferred. You further agree to indemnify and hold Broker harmless from and against any liability, loss, damage or expense (including without limitation, reasonable attorneys’ fees) that Broker may incur in connection with chargebacks against Broker or under the Charter Agreement and your performance thereunder. If Broker incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company or other financial institution, you agree that you will be liable for these costs. If your payment is declined for any reason, you agree to settle any amounts owed to Broker via money order, cashier’s check, personal check or bank/ACH transfer immediately.
• Broker Responsibility . Broker makes arrangements with the Charter Provider. Broker additionally makes additional arrangements with other suppliers for the various components and other services that comprise your Charter (“Charter Suppliers”). Broker is not an agent of these Charter Providers or the Charter Suppliers (and the Charter Providers and Charter Suppliers are not agents of Broker). Broker expressly disclaims any liability for the actions or omissions of the Charter Provider and the Charter Suppliers. The Charter Providers and the Charter Suppliers reserve the right to refuse service to you at their sole discretion. Broker assumes no liability for the acts of the Charter Provider or the Charter Suppliers in refusing service. Broker is not responsible for schedule changes and does not offer compensation for those changes. Broker is not responsible under any circumstances for any injury or damages you may suffer, in connection with sea, air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Broker.

  You understand Broker is not the source or supplier of the Charter or other travel services you requested and acts solely as a broker for the Charter Provider and the Charter Suppliers. You agree that the Charter Provider and Charter Suppliers whose names appear in the information supplied to you are those who are solely responsible for providing the Charter you purchase. You consent to and request the use of the Charter Provider and the Charter Suppliers and agree to not hold Broker responsible should any of them: (i) fail to provide the Charter or travel services you purchased, whether or not such services are listed in the Charter Agreement or otherwise, (ii) fail to comply with any applicable law, or (iii) engage in any negligent act or omission that causes you any sort of injury, damage, delay or inconvenience.

By using Broker’s services, you waive and release any claim against Broker, its affiliated and subsidiary companies, and their respective officers, directors, employees, contractors, and agents, arising out of or in connection with any loss of or damage to property or injury to any person caused by reason of (i) any defect, negligence, or other wrongful act or omission, or any failure of performance of any kind, by any Charter Provider, Charter Suppliers, or any other provider of sea, airline, hotel, ground transportation or any other travel provider connected to or otherwise associated with the Charter, (ii) any claim for inconvenience, loss of enjoyment, mental distress or other similar claim, (iii) any delayed departure, missed connection, substitute accommodation, termination of service or change in fares or rates, and (iv) overbooking, flight or other travel cancellation, lost or misconnected personal property, or any claim arising out of the air transportation portion of your travel, and (v) or any other claim arising out of or otherwise related to the Charter Agreement or services provided by the Charter Provider and the Charter Suppliers.

Excepting only liability that directly arises from the gross negligence or willful misconduct of Broker, you will not hold Broker responsible for any injury, damage or loss you may suffer while on a Charter, whether incurred on the Charter or in connection with any other rental, purchase, excursion or activity, regardless of the relationship of any of the foregoing with the Charter Provider or the Charter Suppliers.

• Your Responsibility . By booking a Charter with Broker, you agree to defend and indemnify and hold harmless Broker, Charter Provider, Charter Suppliers, and each of their respective officers, directors, employees and agents, from and against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal fees, arising out of or in connection with: (i) your breach of these Terms or the documents referenced herein; (ii) your violation of any law or rights of a third party; or (iii) your use of the Broker website.

You will review your Charter Agreement and travel documents for accuracy upon receipt. You understand that it is your responsibility to review the accuracy of all details in the Charter Reservation provided to you, and that you may contact Broker if you have any questions.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

You understand that Broker recommends purchasing travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

• No Warranties . All Charters, products, services, advice and information is provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied to the fullest extent permitted under the law, including but not limited to, warranties of title or implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation request or Charter Reservation; (ii) regarding the availability of Charters, or any other product and/or services through Broker; (iii) that the use of Broker’s website will be error-free; or (iv) regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided by Broker or through Broker’s website.

Broker has no special knowledge regarding the Charter Provider’s or Charter Supplier’s financial condition, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel during or otherwise in connection with your Charter.

• Limitation on Liability . In no event shall Broker, Charter Provider, Charter Suppliers, and/or their respective affiliates, or any employees, agents, officers, directors, members or managers of any of the foregoing (“Broker and Charter Releasees”), be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use the Broker’s website, the Charter or services provided to you in connection with the Charter (including, but not limited to, your reliance upon opinions of the Broker), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Broker and/or any other of the Broker and Charter Releasees have been advised of the possibility of such damages.

If, despite the limitation above, Broker or the Broker and Charter Releasees are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Broker, Charter Provider, Charter Supplier and the Broker and Charter Releasees will in no event exceed, in the aggregate, the greater of (a) the Broker Fee, and (b) One-Hundred Dollars (US $100.00).

The foregoing limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Broker and/or its providers.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

• Limitation on Time to File Claims . ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF RELATING TO BROKER’S SERVICES OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
• Waiver . No waiver by Broker of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Broker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
• Severability . If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
• Governing Law and Mandatory Venue . The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. You agree that any action or proceeding initiated by Charterer against Broker shall be brought solely in the federal and state courts of Hillsborough County, Florida, and you submit to the jurisdiction of those courts and waive any objections to the exercise of personal jurisdiction over you by those courts. In the event any action or proceeding is initiated by Charterer in a court outside of Hillsborough County, Florida, Charterer agrees to pay Broker’s costs and reasonable attorneys’ fees associated with defending such action or proceeding and waives any and all defenses to the transfer of said action or proceeding, whether jurisdictional or otherwise, to a federal or state court in Hillsborough County, Florida.
